Privacy Policy


PRIVACY POLICY Version 1 - April 11, 2003
 

1.

We are committed to respecting the privacy of all of our customers.

We are bound by, and intend to observe, the safeguards for your privacy contained in this privacy policy, the code of ethics of the Manitoba Pharmaceutical Association, the laws of Manitoba and the laws of Canada.

2.

Whenever you send us an order you are giving your consent that we may collect, retain, use or disclose information about you in accordance with this privacy policy.

3.

Our rights and obligations in respect of such information about you are the same whether:
  • you deal with us directly;
  • someone else (such as a health plan, doctor or parent) who has authority to do so, acts in some or all respects on your behalf.
Authority to act on your behalf can arise from either your consent or by operation of law.

4.

Under this privacy policy, we may collect, retain, use or disclose information about you only when it is reasonable for us to do so for any one of the following legitimate purposes:
  • to enable us to fill an initial or further order from you in a safe, ethical and effective manner;
  • to assist you with delivery of the product or service;
  • to obtain payment;
  • to satisfy any legal or ethical requirements that apply to us with respect to obtaining or retaining of information about a customer;
  • to protect our position in the context of possible or actual civil proceedings or government proceedings against us;
  • to comply with the laws of Canada and Manitoba, including complying with court orders.

We may collect information about you only if you give us the information in connection with an order, or if someone else with authority to do so (such as your health plan, doctor or parent) does so on your behalf

6.

Within our company, individual officers and employees may only access, retain, use or share information about you to the extent that is reasonably necessary for a legitimate purpose as set out in point 4 of this privacy policy.

7.

We may share information about you with third parties who provide a service to us, such as our accountants, lawyers or outside data processors.

We will only deal with such third parties whom we reasonably trust to respect and safeguard your privacy. We will give them only the minimum information about you that they need to provide us with their services.

8.

We may similarly share your personal health information with trusted third parties who provide services needed in connection with an order - such as transporting the product to you or paying us for it on your behalf.

9.

We will not retain information about you longer than is reasonably necessary for a legitimate purpose as set out in point 4 of this privacy policy.

10.

We will not sell information about you to anyone outside of our company. The only exception is that we may transfer information about you in the context of a reorganization, or sale or lease of our business, as explained in points 11 and 12 of this privacy policy.

11.

If we are involved in a corporate reorganization, the company that emerges will have the same rights as we do:
  • to retain, use or disclose information about you that we had already collected about you;
  • to seek and collect additional information about you.
  • "Reorganization" includes actions such as changing the ownership or control of our company or merging with, or taking over, another company.
  • Before we reorganize or sell our business, we will take reasonable steps to ensure that that the emerging company or new owner will have a privacy policy equivalent to ours.

12.

The same principles apply if we sell or lease our pharmacy business (in whole or in part). Specifically:
  • The new owner or lessee assumes our position with respect to our rights to deal with or obtain information about you;
  • Before selling or leasing our business, we will take reasonable steps to ensure that the new owner or the lessee has a privacy policy equivalent to ours.

13.

We may send material to you promoting our own products and services unless you ask us at any time not to.

14.

We will take reasonable steps to maintain the security of information we have about you.

15.

You have the right to ask us what information we have about you.

We will respond to your requests promptly. After you review such information, if you point out any inaccuracies, we will correct them.

16.

We will remove information about you from our records at your request, unless it is reasonable for us to retain the information for a legitimate purpose as set out in point 4 of this privacy policy.

17.

We have an employee who is responsible for administering this privacy policy, including responding to requests for information or to addressing complaints.

18.

"Information about you" in this privacy policy means information in a form that can be linked to you.

19.

We may collect, retain, use or disclose data that is about you if we do so in a way that fully protects you anonymity. For example, we might compile and publish or sell statistics about how many of our customers ordered a particular product in a given month.

20.

The privacy policy stated here applies to all of our transactions, including our on-line transactions.

21.

When you use our website, we may place a "cookie" on your computer.

A cookie is a piece of information, or unique identifier, that is placed on your computer which enables a web site to remember information about the choices you make when you visit that site. We use cookies to enhance your on-line experience.

For example they can help us to adjust the sequence of screens in light of preferences you have shown on earlier visits. Most browsers permit you to be alerted to cookies and to block or delete them.

22.

We will post any changes to our privacy policy on our website.

23.

The revised privacy policy will only apply to information collected after the change.

24.

This privacy policy is subject to the authority of any overriding law that applies, such as a legal requirement to comply with a court order.
